Small Business Planning
Corporations, Limited Liability Companies (LLC) and Partnerships are just a few of the business entities that can be used. Selection of the appropriate business entity can provide valuable benefits to your business. In conjunction with your accountant, I can help you select an appropriate business entity, draft the necessary contracts to accomplish your business needs and review business agreements, such as office leases, to help you understand the benefits and liabilities of those agreements. If you wish to purchase or sell an existing business, I can assist in the negotiations and draft the documents to transfer ownership of that business. Despite which form of business you choose, it is important to maintain your business as a separate entity. If you do not treat your business as a separate entity, and you get into trouble, the court may ignore the corporate protections that you thought existed and allow others to attach your personal assets. Estate PlanningWills, Trusts, Powers of Attorney, Health Care Directives, Community Property Agreements and other estate planning documents should be considered when putting together your estate plan. A proper estate plan includes who is to be a recipient of your estate and when they are to receive their inheritance. For individuals with small children, a decision must be made on who will raise the children upon your death and who will manage their money. Without a properly drafted Will, the Court will make all of the decision and your children will receive their inheritance upon reaching the age of 18. Many children do not become financially mature until they reach the age of 25 or 30 or even later in life. Whether your estate is large or small, your estate plan should be tailored to meet your specific needs. ProbateThe word probate is a word that scares many people. Probate is merely the legal process of finalizing the decedent's estate. Probate includes: making sure the decedent's remains are properly interred, paying his/her outstanding bills, collecting any moneys that are owed to the decedent, and the distribution the decedent's assets to his or her heirs. The legal process can seem complicated for those who attempt to do it alone. I can assist you with each step of the probate process so the decedent's wishes are fulfilled and the process is completed in a timely manner. Family LawThere are many legal issues facing today's families. When a marriage ends, the process of divorce can be very traumatic and difficult. For families who can agree upon how to divide their assets and only need an attorney to assist them with drafting the paperwork, helping them negotiate the court system, and drafting transfer documents, I am available to assist you. |
